TERMS OF USE

Social Lens Consulting Private Limited (Social Lens /we/us/our) provides you with its services made available through the website www.volunteeRISE.com (Platform) accessible over the internet on web enabled devices. Your use of this Platform is subject to our Terms of Use and the Privacy Policy and all other rules and policies related to our service. By accessing our Platform, you indicate to have read, understood, and agreed to be bound by the most recent version of these Terms of Use and all other applicable laws and regulations, without any limitation or qualification.

This document is an electronic record under the Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes under applicable Indian laws. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Our Rights to the Platform

  1. The Platform is designed, updated and maintained independently by us. When you access the Platform, you do so under a license granted from us. All rights, titles and interests in and to the Platform itself, together with all the intellectual property related thereto including inter alia the domain name, copyrights in the resources made available on the Platform and the Platform itself, the look and feel of the Platform, the trade name and trademarks, patents and designs are our sole property.
  2. All third-party trademarks and brand names that appear on the Platform are the property of their respective owners.
  3. We reserve the right to alter, modify, and/or filter the content on the Platform at any time.

    We respect the copyright of others, and we persuade our users to do the same. We may, in appropriate circumstances and at our discretion, disable and, or terminate the access of users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement on the Platform, please contact us at contact@volunteerise.com.
  4. We reserve all rights not expressly enumerated in these Terms of Use.
  5. Your Access and Use of Our Platform

  6. You may access and avail the resources available on the Platform only when duly authorized by us per the terms set out herein. You are not authorized to commercially exploit the Platform in any event whatsoever, unless specifically approved in writing by us.
  7. This Platform and the contents hereof are distributed without any warranty; and without even the implied warranty of accuracy, merchantability or fitness for a particular purpose.
  8. The access to our Platform is limited for customers in India. In order to avail our services, you must be at least 18 years of age. For users below the age of 18, consent should be provided by the holder of parental responsibility and, or, the guardian of the child.
  9. You may be required to register with our Platform using your email address whereafter you will receive an email from us with the link to create an account with a predefined username and the option to set your password on the Platform. You can register with the Platform as a (i) Mentor; (ii) Mentee; (iii) NGO SPOC; (iv) Corporate SPOC; and (v) Project Management Team.
  10. You are responsible for maintaining the confidentiality of your account details viz username and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account on the Platform. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.
  11. Once you have logged-in to the Platform using your account details, you are mandatorily required to fill-in a registration form and submit the following details to create and maintain an account with us, and, or access the Platform:
    1. Details of the first and last name;
    2. Contact Number;
    3. E-mail Address;
    4. Age;
    5. Gender;
    6. Language Proficiency;
    7. Location;
    8. Skills;
    9. Professional expertise and experience;
    10. Area(s) of interest;
    11. Schedule Preference and any other details you may provide to us as part of your profile.
  12. Upon submitting a duly filled registration form, you will be able to access the following resources through your account: (i) The Mentoring Program E-Book; (ii) Mentee Guidelines; (iii) Portal Navigation Guide; and (iv) Mentor/ Mentee Profile Data.
  13. The scope of interaction available for each user is as follows:
    End-User Role Details Scope of Interaction with the Platform
    Volunteer
    1. View resources available on the Platform;
    2. Edit and save changes to their profile;
    3. Explore and Apply for projects;
    4. View and download relevant data uploaded by Project Management team, if any;
    5. Update project/session progress and upload work plan, submission and case study, if any;
    6. View assigned schedules, if any;
    7. Input session attendance, if any;
    8. Give feedback relevant to the program; and
    9. Receive regular emails from the Platform.
    Corporate SPOC
    1. View resources available on the Platform;
    2. Upload volunteer profiles; and
    3. View analytics with respect to volunteer and project progress for the particular corporate.
    Project Management Team
    1. View resources available on the Platform; and
    2. Complete access to all modules on the Platform.
    NPO SPOC, if given access by Project Management team
    1. View resources available on the Platform;
    2. View project progress for the particular NPO.
    Beneficiaries, if given access by Project Management team
    1. View resources available on the Platform;
    2. Edit and save changes to their profile;
    3. View assigned schedules, if any;
    4. Input session attendance, if any;
    5. Give feedback; and
    6. Receive regular emails from the Platform.
  14. You agree to use the Platform, in accordance with the applicable laws, rules and regulations, or other restrictions applicable on use of the service or content therein. You further agree not to reproduce, distribute, modify, display, perform, archive, publish, license, create derivative works from, offer for sale, or use (except as expressly authorized under these Terms of Use) any content and information contained on or obtained through our Platform. You also agree not to circumvent, remove, degrade, or deactivate any of the contents of our Platform; and, or, use any robot, spider, scraper or other means to access our Platform. You also agree not to decompile, reverse engineer, and disassemble any software or processes accessible through our Platform. You further agree not to insert any code or manipulate the content of our Platform in any way; or use any data mining, data gathering or extraction method on the Platform.
  15. Additionally, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of our service on the Platform. We may terminate or restrict your use of our Platform if you violate these Terms of Use or engage in any illegal or fraudulent use of our Platform. We reserve the right to suspend or cancel the service at any time if a computer virus, bug, or other technical problem corrupts the security, or proper administration of the Platform.
  16. Any personal information you provide to us is subject to your understanding and acceptance of our Privacy Policy, and we encourage you to read the same before you access the Platform.
  17. You represent and warrant that any information provided by you in connection with your use of the Platform is and shall remain true, accurate and complete, and that you will maintain and update such information regularly. You agree that if any information you provide to us is false, inaccurate, obsolete or incomplete, we may terminate your use of and access to the Platform.
  18. Third Party Applications

  19. You are not allowed to integrate any third-party application or other developer product that integrates with the Platform and make it available for other users. All such integrations must be authorised and routed by us.
  20. Third Party Vendor Interaction

  21. The license for some of our services may contain additional terms. When such licenses contain additional terms, we will make such terms available to you. We will neither be held liable or responsible for anything outside the Terms of Use of our services nor for any commissions or omissions of the third-party vendors.
  22. We are not responsible for and have no liability for the functionality, actions, inactions, privacy settings, privacy policies, terms and conditions and content of any third-party vendors. We strongly advise that you review and understand the terms and conditions, privacy policies, settings and information sharing functions of each such third-party websites or platforms. Your use of third-party websites and resources is at your own risk. We do not make any representations or warranties on or about the accuracy and durability of the third-party vendor services offered to you.
  23. Termination

  24. We reserve the right, without notice and in our sole discretion, to terminate your account or your use of our Platform, and to block or prevent future access to and use of the Platform if you violate the Terms of Use or the Privacy Policy. We may place limits on and modify and, or, terminate your right to access and use of the Platform at any time. Upon such suspension or termination, your right to use the Platform will immediately cease. You agree that any termination of your access to or use of the Platform may be effected without prior notice, and that we may delete information, files, and other content previously available to you, and/or bar any further access to such information, files and other content.
  25. Your access to the Platform may also be terminated due to any requests by authorized law enforcement or other government agencies.
  26. Survival

  27. All provisions of these Terms of Use which by their nature should survive termination will survive termination, including, without limitation, all representations, warranties and limitations, indemnification and liability.
  28. Warranties and Limitations

  29. You expressly understand that use of the Platform is at your own risk and discretion. Our service to you, including the Platform and its contents is provided ‘as is’ and is without any warranty or condition, expressed or implied. Without limitation, we do not warrant fitness for any timely, error-free, uninterrupted and free from unauthorized access services, and the accuracy, fitness and legality of the content on the Platform or its server. We and our subsidiaries, affiliates, officers, employees, or licensors make no warranty that:
    1. The Platform will meet your requirements;
    2. That any defects or errors will be corrected; and,
    3. The results that may be obtained from the use of the Platform will be accurate or reliable. No advice or information, whether oral or written, obtained by you from us or through the service shall create any warranty not expressly stated in the Terms of Use.
  30. You assume full responsibility and any risk of loss resulting from your accessing, downloading, and / or use of the files, information, content or any other material obtained from the Platform.
  31. Indemnification

  32. In order to use the Platform, you agree to defend, indemnify and hold us harmless from any claim or demand, Social Lens and its subsidiaries, affiliates, officers, agents, respective employees, directors, officers, vendors, partners, licensors and suppliers from and against any liabilities, losses, investigations or inquiries, claims, suits, costs and expenses (including without limitation – reasonable attorneys’ fees and expenses) arising out of or otherwise relating to your use of the Platform and the contents thereof, your violation of the Terms of Use, or your violation of any rights of another party.
  33. Intellectual Property

  34. All content displayed on the Platform including inter alia designs, labels, text, logos, images, information, graphics (Content) is owned and licensed by us or our content suppliers, and is protected by copyright, trademark, design and other proprietary rights. The collection, arrangement and assembly of all Content on the Platform is our exclusive property and protected under the applicable laws. The Content of the Platform is intended solely for personal, non-commercial use by the users. You may not modify or alter the Content in a way, delete and/or change any copyright or trademark notice.
  35. We and our suppliers and licensors expressly reserve all intellectual property rights in all text, designs, products, processes, technology, content and other materials that appear on the Platform. Access to the Platform does not confer and shall not be considered as conferring upon anyone any license under any of ours or any third-party’s intellectual property.
  36. Modifications to the Platform

  37. We reserve the right at all times to modify, discontinue, temporarily or permanently, the Platform without notice. You agree that we will not be liable to you or any third party for any modification, suspension or discontinuation of the Platform.
  38. Governing Law and Dispute Resolution

  39. These Terms of Use will be governed by the laws of India, and for resolution of any dispute arising out of your use of our Platform, the courts of India shall have exclusive jurisdiction.
  40. Severability

  41. If any provision or provisions of these Terms shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
  42. Liability

  43. To the maximum extent permitted by applicable law, Social Lens and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any act and, or conduct and, or content and, or omission of any third-party on the services including without limitation, any defamatory, offensive or illegal conduct of other users or third-parties; (iii) any content obtained from the Platform; or (iv) unauthorized access, use or alteration of your transmissions or content on the Platform.
  44. Changes to Terms of Use and Assignment

  45. We may from time to time change and implement the Terms of Use. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer. We recommend that you periodically check this page for any revised terms. Your continued use of the Platform will be deemed to constitute your acceptance of all of such revised terms. If you do not agree to the change(s) made to the Terms of Use, you must immediately stop using the Platform.
